Terms of Service

These Terms of Service (“Terms”) govern your use of koypantry.com (the “Site”) and any purchase you make from KOY Pantry (“Koy Pantry,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who can use the Site

The Site is intended for use by individuals located in the United States, and we ship only to addresses within the United States. We are not able to accept orders for delivery outside the United States. You must be at least 18 years old, or the age of majority in your state, to place an order.

2. Products, pricing, and availability

  • All product descriptions, images, weights, and prices on the Site are accurate to the best of our knowledge at the time of publication, but errors can occur. We reserve the right to correct any pricing or product information error at any time, including after an order has been placed.
  • Prices are listed in U.S. dollars. Any applicable sales tax is calculated at checkout and shown to you before you pay.
  • Product availability is not guaranteed until your order is confirmed. If an item you ordered becomes unavailable after you place your order, we will contact you and either refund that item or offer a substitute, at your choice.
  • We reserve the right to limit the quantity of any product a single customer or order may purchase.

3. Orders, payment, and order acceptance

  • Placing an order through the Site is an offer to purchase, which we may accept or decline. We may decline or cancel any order for reasons including suspected fraud, pricing errors, or an inability to fulfill the order.
  • Payment is processed securely through Stripe. By placing an order, you authorize us, through Stripe, to charge your payment method for the full order total, including any applicable tax and shipping.
  • You will receive an order confirmation email once your order is accepted. This confirmation does not guarantee product availability — see Section 2.
  • Order changes and cancellations. If you need to change or cancel an order, contact us at [email protected] as soon as possible and include your order number. We will do our best to make the change while the order is still being prepared. Once an order has been processed for shipment, it can no longer be changed or canceled.

4. Shipping and returns

5. Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized use of your account.

6. Food product and allergen notice

Koy Pantry products are food items intended for human consumption. Please read the product labels and this section carefully before purchasing or consuming any product.

  • Allergens. Our products include tree nuts, including pistachio, and may be processed in facilities that also handle other tree nuts, wheat, and other common allergens. If you have a food allergy or sensitivity, review the ingredient label on the product packaging before consuming, and contact us at [email protected] with any questions before you order.
  • Storage and use. Store and use products according to the instructions on the packaging. We are not responsible for issues arising from improper storage, handling, or use after delivery.
  • No medical advice. Nothing on the Site is medical or dietary advice. If you have a medical condition, allergy, or dietary restriction, consult a qualified professional before consuming any product.
  • Perishable and consumable nature. Because these are food products, see our Shipping & Returns page for how we handle damaged, incorrect, or unsatisfactory items.

7. Intellectual property

All content on the Site — including the Koy Pantry name, logo, product photography, written copy, and site design — is owned by Koy Pantry or its licensors and is protected by U.S. and international intellectual property law. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission, except for ordinary personal use of the Site, such as printing an order confirmation for your own records.

8. User conduct

When using the Site, you agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;
  • attempt to gain unauthorized access to the Site, other users’ accounts, or our systems;
  • interfere with the Site’s normal operation, including through automated scraping, bots, or denial-of-service attempts;
  • submit false or fraudulent order or payment information.

We reserve the right to suspend or terminate access to the Site, or any account, that violates these Terms.

9. Limitation of liability

To the fullest extent permitted by law:

  • The Site and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, except as required by law or as stated on our Shipping & Returns page.
  • Koy Pantry, its owners, and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of our products, including but not limited to loss of profits, data, or goodwill.
  • Our total liability for any claim arising from your use of the Site or a product purchase will not exceed the amount you paid for the products giving rise to the claim.
  • Nothing in this section limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or personal injury caused by a defective product where such a limitation is not permitted.

10. Indemnification

You agree to indemnify and hold Koy Pantry, its owners, employees, and affiliates harmless from any claim, loss, or damage — including reasonable attorneys’ fees — arising from your violation of these Terms or misuse of the Site.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles.

12. Changes to these Terms

We may update these Terms at any time. If we make material changes, we will update the date at the top of this page. Continued use of the Site after changes take effect means you accept the updated Terms. We encourage you to review this page periodically.
